Terms of Service

OpenFundraise provides fundraising software for nonprofit and charitable organizations, including donation forms, hosted checkout pages, campaign tools, donor management, attribution, communications, and payment processor integrations.

By using OpenFundraise, you agree to these Terms of Service, our applicable product documentation, and the rules of any payment processor or third-party service connected to your account, including PayPal's Acceptable Use Policy when PayPal is used.

OpenFundraise is intended for legitimate nonprofit, charitable, religious, educational, community, and mission-driven organizations. We may decline, suspend, or terminate any account that we cannot reasonably verify or that presents elevated legal, compliance, fraud, reputational, or payment risk.

You represent that the organization information you provide is accurate, that you are authorized to act on behalf of the organization, and that your fundraising activity complies with all applicable laws, payment processor rules, and charitable solicitation requirements.

During onboarding, OpenFundraise may collect information about the organization and its authorized users, including legal organization name, DBA or public name, website, EIN or registration number, charity registration information, physical address, contact email, phone number, administrator names, role or title, campaign information, payment processor account details, and supporting documentation.

OpenFundraise does not generally require date of birth for ordinary dashboard access, but payment processors or verification providers may collect date of birth, government identification, beneficial ownership information, tax information, bank account information, or other identity data when required for KYC, KYB, underwriting, or payout eligibility.

We may verify customer information using public nonprofit registries, government databases, IRS or charity registration records, the customer's website and public materials, email/domain checks, payment processor onboarding results, document review, sanctions or watchlist screening, fraud signals, transaction monitoring, manual review, and follow-up requests for more information.

OpenFundraise is not a bank, money transmitter, or payment processor. Payments are processed by connected providers such as PayPal, Stripe, Square, or other supported processors. Use of those processors is subject to their terms, acceptable use policies, underwriting, reserves, dispute processes, and account decisions.

If a processor rejects, limits, suspends, reverses, refunds, or holds a transaction or account, OpenFundraise may restrict related platform functionality and cooperate with the processor's compliance review.

You may not use OpenFundraise for campaigns, organizations, transactions, messages, or activities that violate applicable law, payment processor rules, PayPal's Acceptable Use Policy, sanctions laws, or these Terms.

Prohibited activities include fundraising for illegal goods or services; fraud, scams, deceptive campaigns, misrepresentation, impersonation, or fake charities; hate, harassment, discrimination, or extremist activity; violence, weapons, explosives, or instructions to cause harm; adult sexual content or services; controlled substances, illegal drugs, drug paraphernalia, or unsafe regulated products; gambling, raffles, lotteries, or games of chance where not legally authorized and approved by the processor; counterfeit goods or intellectual property infringement; money laundering, terrorist financing, sanctions evasion, or activity involving sanctioned persons, regions, or entities; high-risk financial products, debt collection, credit repair, bail bonds, or other restricted financial services; political campaigns or lobbying where restricted by law or processor policy; medical claims, cures, or products that are unlawful or misleading; and any activity that creates unacceptable legal, compliance, reputational, or payment risk.

We may also restrict campaigns involving crisis relief, personal fundraising, religious or political content, international aid, raffles, auctions, in-kind goods, restricted beneficiaries, or other sensitive categories until additional documentation, authorization, or payment processor approval is provided.

You are responsible for ensuring that campaign pages, donation forms, receipts, SMS messages, emails, and donor-facing statements are truthful, current, and not misleading. You must clearly identify the beneficiary organization and the intended charitable purpose of each campaign.

You may not send unlawful, unsolicited, deceptive, or abusive communications through OpenFundraise. You are responsible for obtaining and honoring all required consents, opt-outs, and privacy rights for email, SMS, and other donor communications.

OpenFundraise may review accounts, campaigns, traffic, messages, and transaction metadata to prevent fraud, abuse, policy violations, security incidents, and processor rule violations. We may request additional information at any time.

We may remove content, pause campaigns, disable payment methods, suspend or terminate accounts, preserve records, notify processors, or report activity to law enforcement or regulators when we believe it is necessary to protect donors, customers, processors, OpenFundraise, or the public.

You must use donor data only for lawful fundraising, stewardship, reporting, and organization management purposes. You may not sell donor data or use donor data in a way that violates privacy laws, consent requirements, or donor expectations.

OpenFundraise uses technical and organizational safeguards designed to protect platform data. Payment credentials and card data are handled by supported payment processors or tokenized processor integrations rather than stored as raw card data by OpenFundraise.

We may update these Terms from time to time. The updated version will be posted on this page with a new effective date. Continued use of OpenFundraise after changes become effective means you accept the updated Terms.
